Heard Sri M.S. Pandey, learned counsel for the petitioner and Sri Mahboob Ahmad, learned counsel for the respondent no. 2.
The petitioner was found to be using electricity unauthorisedly during vigilance enquiry. Accordingly, a provisional bill has been issued upon him on 3.9.2018 for a sum of Rs. 1,36,647/-.
The petitioner has filed this writ petition for quashing the provisional bill and the notice and demand.
The submission of learned counsel for the petitioner is that he is not having any electricity connection in his name and that he has wrongly been provisionally assessed.
The petitioner, in this connection, has filed objections before the Executive Engineer.
In view of the aforesaid objections of the petitioner, we dispose of the writ petition with the direction to the Executive Engineer, Electricity Distribution Division Handia, U.P. Power Corporation Ltd. Allahabad (respondent no. 2) to consider the said objections before finalising the electricity demand against the petitioner. The objections shall be considered and decided in accordance with law, if possible within a period of one month from the date, a copy of this order is produced before the Executive Engineer.
With the aforesaid direction, the writ petition is disposed off.
