Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 2445 of 2016 Applicant :- Mohd. Naim Opposite Party :- Vaibhav Kumar Srivastava, D.M., Mau Counsel for Applicant :- Anand Priya Singh,Gokaran Singh Counsel for Opposite Party :- S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
From the disclosures made in the short counter affidavit, the Court notes that after conclusion of consolidation operation and the drawl of CH Form-45, the plot Nos. 120 and 122 came to be recorded as pond while plot No.121 was reserved for 'quarters'. The State thereafter appears to have approved an exchange and in lieu thereof these plots were allotted to certain private individuals. This exchange became subject matter of litigation in this Court being Writ Petition No. 52212 of 2003 in which an order of injunction operates.
In light of the aforesaid facts, the Court finds no ground to continue these proceedings in contempt which shall stand disposed of.
