JUDGMENT / ORDER

Court No. - 21
Case :- SPECIAL APPEAL No. - 672 of 2018 Appellant :- Mohd. Nafees Respondent :- State Of Up And Another Counsel for Appellant :- Jiya Lal Patel Counsel for Respondent :- C.S.C.,Chandan Agarwal
Hon'ble Govind Mathur,J. Hon'ble Chandra Dhari Singh,J.
This appeal is preferred to challenge the order dated 20th of April, 2018 passed by learned Single Bench in Writ 20500 of 2014 (Mohd Nafees Vs. State of U.P. and Another).
Learned Single Bench after considering all aspects of the matter arrived at the conclusion that the Uttar Madhyama and Purva Madhyama Certificates said to be issued by Vedamau Vaidik Vidyapeeth Badaun are neither having any valid recognition nor have been issued by the Sampurnanand Sanskrit Vishvavidyalaya Varanasi. The certificates aforesaid, as such, does not satisfy the qualificational eligibility to hold the post of Assistant Teacher.
In appeal, the argument advanced by learned counsel appearing on behalf of the appellant is that under the communication dated 2nd of December, 1982, the Secretary, Central Board of Higher Education communicated to the Registrar, Vedamau Vaidik Vidhyapeeth Badaun, Uttar Pradesh that the Standing Committee of the Board has decided to recognize the examination of Pratham Pariksha, Uttar Madhyama and Purva Madhyama equivalent to the examinations conducted by the Board. This fact was also noticed by the Principal of the District Education and Training Institute Badaun in its report dated 21st of June, 20 1 and, as such, the finding arrived by learned Single Bench is erroneous.
We do not find any merit in the argument advanced.
As a matter of fact, learned counsel utterly failed to satisfy us about the Authority of "Central Board of Higher Education" Vachaspati Bhawan Uttam Nagar, New Delhi to recognize and verify equivalence of the examinations conducted by the Vedamau Vaidik Vidyapeeth. There is no material available on record even to establish legal sanctity of the Central Board of Higher Education addressed above.
In view of whatever stated above, we do not find any reason to interfere with the order passed by learned Single Bench.
The appeal is having no merit, hence is dismissed.
Order Date :- 30.7.2018 Rameez .
