Heard Shri Satish Sharma, learned counsel for the petitioner and learned A.G.A. for the State-respondents.
This petition has been filed by the petitioner seeking quashing of the first information report dated 10.6.2021, registered as Case Crime No.0188 of 2021, under Section 2/3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station- Kydganj, District- Prayagraj, with a further prayer not to arrest the petitioner in pursuance of the said F.I.R.
The sole submission is that in all four cases, which have been mentioned in the first information report, the petitioner has been released on bail. A perusal of the gang-chart shows that in all four criminal cases lodged against the petitioner in past, the police after investigation has submitted charge-sheet. The facts stated in the first information report as well as the material on record is sufficient to warrant lodging of the impugned F.I.R. under the provisions of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986.
No case is made out to quash the F.I.R. The petition lacks merit and is dismissed.
