Hon'ble Govind Mathur,Acting Chief Justice Hon'ble Chandra Dhari Singh,J.
While relying upon the notice dated 15.06.2018, learned counsel for the petitioner submits that no action has yet been taken by respondents to remove the encroachment from the graveyard (kabristan).
We do not find any reason to interfere in the matter in view of the fact that Tehsildar, Auraiya by the notice dated 15.06.2018 has directed the alleged encroachers to get their encroachment removed with further averment that, in the event of not vacating the premises in question, the encroachment shall be removed by taking help of police force. This notice itself is sufficient to arrive at the conclusion that the respondents Authorities are taking appropriate steps to remove the encroachment.
No interference, as such, is warranted. The petition for writ is dismissed accordingly. The petitioner is at liberty to pursue his case before the Administrating Authority.
Order Date :- 26.10.2018 Shubham .
