HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40734 of 2014 ORDER:
In pursuant to the notification issued on 15.09.2013 by the respondent Corporation calling for applications for enlisting of the LPG Distributor in Adilabad District including the location at Bhainsa, Adilabad District, the petitioner has also applied. After preliminary verification of the eligibility, the petitioner was also subjected to selection process by way of draw of lots. The case of the petitioner is that the draw of lots was held on 30.10.2014 and the 4th respondent was selected as eligible to award the dealership. Alleging that the 4th respondent is not eligible and that he has produced false and fabricated documents, the petitioner complained to the Chief Area Manager of the respondent Corporation on 24.11.2014. The grievance of the petitioner necessitating institution of this writ petition is that in spite of receiving of complaint, the respondent Corporation has not considered the said complaint and is proceeding to finalize the selections in favour of the 4th respondent.
2. Sri Thoom Srinivas, learned Standing Counsel for the respondent Corporation, submits that in accordance with the guidelines governing the selections, whenever a complaint is received, the same would be attended to before finalizing the selections.
3. Having regard to the said submission, the Writ Petition is disposed of directing the respondent Corporation to consider the complaint given by the petitioner on 24.11.2014 and take a decision on the said complaint before finalizing the selections for appointment of a dealer for the LPG Distribution in Bhainsa Mandal, Adilabad District. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
