Counsel for the petitioner has challenged inaction of the respondents in reference to the violation of Water (Prevention and Control of Pollution) Act, 1974 (in short "Act of 1974") and Air (Prevention and Control of Pollution) Act, 1981 (in short "Act of 1981").
It is stated that respondent no.5 is running a Brick Kiln in the residential area despite restrained by this Court as well as Apex Court. A representation for taking action in the matter was submitted by the petitioner but no action in reference to it has been taken by U.P. Pollution Control Board. The prayer is to direct for appropriate action in the matter without delay as otherwise running of Brick Kiln is causing air pollution in the area in which the petitioner is residing.
Taking into consideration the limited direction sought by the petitioner, the writ petition is disposed of with a direction to the U.P. Pollution Control Board to immediately take action in the matter pursuant to the representation submitted by the petitioner rather the petitioner is directed to submit a copy of the representation along with a copy of this order for necessary action. On the receipt of the copy of this order, appropriate action, as envisaged under the law, would be taken within a period of three months.
