HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.26790 of 2014 ORDER:
This writ petition is filed declaring the action of the second respondent in not paying the arrears to the tune of Rs.7.00 lakhs due and payable to the petitioner without any justification as illegal and arbitrary and on account of the delay in payment of amounts due, grave prejudice would be caused to the petitioner.
2. On behalf of the 2nd respondent, counter-affidavit is filed. It is categorically asserted in para-5 of the counter-affidavit that bills payable for the month of July, 2014, are already paid. With reference to the bills payable for the months of August, 2014 and upto 15th September, 2014, the petitioner has not filed any bill by enclosing the proof of statutory payments, such as, contribution to ESI, provident fund and service tax. Without petitioner submitting the bills, the question of payment of amounts would not arise and, therefore, on account of non-submission of bills by the petitioner only, the amounts payable to the petitioner are not released.
3. At this stage, learned counsel for the petitioner submits that petitioner would submit an application enclosing all the relevant receipts as proof of payment of statutory amounts payable and as and when such claim is made, the second respondent shall consider the same and release the amounts due and payable to the petitioner as per the terms of the contract.
4. With the above observations, this writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
