|

JUDGMENT / ORDER

Court No. - 1
Case :- CRIMINAL MISC. WRIT PETITION No. - 24402 of 2018 Petitioner :- Mohd. Kaif Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Mohit Singh Counsel for Respondent :- G.A.
Hon'ble Ramesh Sinha,J. Hon'ble Dinesh Kumar Singh-I,J.
Learned counsel for the petitioner is permitted to make necessary correction in the present petition.
Heard Sri Kaushal Kumar holding brief of Sri Mohit Singh, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R. dated 24.3.2018 registered as case case crime no. 210 of 2018 under section 279, 304-A I.P.C., police station Nakhasa, District Bheemnagar.
Learned A.G.A. has pointed out that the offence in question is a bailable one to which learned counsel for the petitioner could not give a satisfactory reply.
After having examined the submissions advanced by learned counsel for the parties, we are of the opinion that no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR as the offence in question is bailable one.
The petition lacks merit and is, accordingly, dismissed.
(Dinesh Kumar Singh-I, J.) (Ramesh Sinha, J.) Order Date :- 5.9.2018 Shiraz
