Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents.
Present petition has been filed for quashing the order dated 23.7.2021 passed by the respondent no. 2 in Case No. 1159 of 2021 (State vs. Mohd. Zaved) under Section 17(3) Indian Arms Act, 1959.
The petitioner has alternative remedy by way of filing appeal under Section 18 of Indian Arms Act, 1959.
In such view of the matter, I am not inclined to entertain present petition.
At this stage, learned counsel for the petitions submits that the appeal may be time barred.
In the interest of justice, it is provided that in case the petitioner files appeal appeal within a period of three weeks, the same shall be entertained by the appellate authority without raising objection regarding limitation.
With the aforesaid observation, present petition stands dismissed.
