By order dated 28.7.2018, the trial court has allowed the amendment in plaint of Original Suit No.1013 of 2011. The revision filed by the petitioner against the said order has been rejected by impugned order dated 11.9.2018 on the ground that it is not maintainable.
After some argument, counsel for the petitioners prayed for withdrawal of the petition with liberty reserved in favour of the petitioners to challenge the order allowing amendment application in appeal in case ultimately the suit is decreed in favour of the petitioners and occasion arises for filing an appeal.
Accordingly, the prayer made is allowed. The petition is disposed of as withdrawn with liberty reserved in favour of the petitioners to challenge the order of the trial court in appeal against the final judgement.
