Heard learned counsel for the petitioner and learned standing counsel for State-respondents.
Present petition has been filed seeking following relief:-
"i) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 2 to consider and decide the application/representation dated 07.09.2021 with regard to transfer the Antyodaya Ration Card No. 219920056155 in the name of the petitioner in place of his Grand Mother who had died on 30.04.2021 within the stipulated time."
Learned counsel for the petitioner submitted that application of the petitioner dated 07.09.2021 is pending for more than one year, due to which he could not able to receive essential commodities from fair price shop. Lastly, it is submitted that a direction may be issued to respondent No. 2 to decide the application of the petitioner within a stipulated time for which learned standing counsel has no objection.
In view of the facts and circumstances of the case, with the consent of parties, the writ petition is disposed of directing respondent No. 2 to decide the application of the petitioner in accordance with law maximum within period of four weeks from the date of submission of computer generated copy of this order after verifying the same from Official Website of Allahabad High Court.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 2 to decide the claim petition of the petitioner after considering relevant Rules, Regulations or Government Order occupying the field.
