. Respondents Petition under Article 226 of the Constitution of India, praying that in the circumstances stated in the Affidavit filed herein, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the 2nd respondent for not directing the 3rd respondent for issuing the registration number to the petitioner's vehicle which is illegal, arbitrary, unjust and consequently direct the 3rd respondent to issue the registration number to the petitioner's vehicle.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Smt. Shahina Khan, Advocate for the Petitioner and the learned Asst. G.P. for Roads, Transport & Buildings for the Respondents, the Court made the following ORDER:
It is now brought to my notice by the learned A.G.P. for Roads, Transport and Buildings that another vehicle bearing same registration number assigned to it by the U.P.State Government, has already been registered with the registration authority at Adilabad.
In view of the difference in the engine number and chassis number between the vehicle belonging to the writ petitioner and the said 3rd party, who got the vehicle re-registered in Adilabad, action is initiated for cancellation of re-registration certificate issued in so far as the 3rd party in Adilabad is concerned. It appears the R.T.O, Adilabad has also passed appropriate cancellation orders recently. Hence, action in so far as the re-registration of the petitioner’s vehicle is also initiated.
In view of this statement, I hope and trust that the re-registration work of the petitioner’s vehicle would be accomplished as expeditiously as is possible, preferably within a period of 30 days from today and inform the Court about the action taken in that regard. It is agreed by both sides that the writ petition can be posted for judgment.
