In the year 2008 the petitioners were granted a lease, of an area of 0.506 hectares, for plantation of trees. This allotment has been cancelled by the Assistant Collector, Sandila, Hardoi, vide order dated 9.12.1993 on the ground that no trees have been planted and that only 3 or 4 trees, about 1 ft. in height, are standing. It is this order, which has been impugned in this writ petition.
Initially, when the matter came up for admission, vide order dated 21.1.2014 the parties were directed to produce the Government Order, whereunder the patta was granted for plantation of trees for a period of 30 years. This Govt. Order was produced by the learned counsel for the Gaon Sabha. The matter was thereafter adjourned to 6.2.2014 on the prayer made by the learned counsel for the petitioners that he wanted to obtain instructions in the matter. This order was passed on 5.2.2014.
When the matter came up on 6.2.2014, it was directed to be put up on 10.2.2014. On 10.2.2014, further time was prayed for by the learned counsel for the petitioners on the ground that he had not been able to obtain instructions. In view of the same, the matter was directed to be put up as unlisted on 11.2.2014, that is today.
When the matter was taken up today, learned counsel for the petitioners states that he does not want to press the writ petition. The writ petition is, therefore, dismissed as not pressed.
It is, however, made clear that no liberty is being granted to the petitionrs to file a fresh writ petition on the same cause of action.
