Perusal of order sheet shows that notice was issued by the Court to the revisionist and the same was served personally upon him but none responds on behalf of revisionist.
This criminal revision has been directed against the impugned judgment and order dated 10.10.1995 passed by the Principal Judge, Family Court in Case No. 796 of 1994, 'Smt. Julekha Nisha and another versus Mohd. Ibrahim whereby Rs.300/- has been awarded to the opposite party no.2 and Rs.200 has been awarded to the opposite party no.3, total Rs.500/- per month for maintenance passed on application under Section 125 Cr.P.C.
Heard learned AGA for the State and perused the material available on record.
From perusal of impugned order, material available on record and having heard the learned AGA, I see no illegality or irregularity committed by the Court below in passing the impugned order. I also do not find any good ground to interfere in the same. No interference is warranted.
Moreover, it appears that either cause of action or any interest to the revisionist no more survives or by efflux of time revisionist lost interest in the matter or it has otherwise become infructuous and probably for this reasons, none is interested to have decided this matter on merit and that is why counsel for the revisionist is absent.
Revision is dismissed accordingly.
However, it is open to the revisionist to approach this Court to recall the order, if any, interest or cause of action still survives.
