1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant - Mohd. Hasan Qureshi @ Munna, seeking anticipatory bail in Case Crime No.32 of 2021, under Sections -3/5/8 of U.P. Cow Slaughter (Prevention) Act, Police Station - Puranpur, District - Pilibhit, during pendency of trial.
3. Learned counsel for the applicant submits that applicant has been falsely implicated owing to the statement of co-accused. Though, the applicant is named in the FIR but no recovery was made.
4. On the other hand, learned A.G.A. submits that there is criminal history of the applicant and anticipatory bail of co- accused has already been disposed of by this Court without granting anticipatory bail vide order dated 12.2.2021, passed in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No.2799 of 2021.
5. In view of the direct fact allegation made in the FIR and criminal history of the applicant, the discretion claimed for grant of anticipatory bail is declined.
6. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicant to apply for regular bail, which application when filed may be dealt with on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
