Heard learned counsel for the parties.
The petitioners claim that they were appointed as Assistant Teachers in the institution run by respondent no.5, Madarsa Qurania, Zama Maszid, Jaunpur. It is stated that the institution in question is a recognized institution. The institution has advertised the post of Assistant Teachers. In pursuance of the said advertisement, the petitioners applied for the said post. The Committee of Management of the institution forwarded the papers to the respondent no.3 for according approval to the appointment of the petitioners. However, no action has been taken by the respondent no. 3 on the papers submitted by the respondent no.5.
Aggrieved by the said action, the petitioners preferred this writ petition for the following relief.
"i). issue a writ, order or direction in the nature of mandamus directing the respondent no.3 to accord approval to the appointment of the petitioners on the respective post in the aforesaid Madarsa of respondent no.5 within stipulated time.
ii). issue a writ, order or direction in the nature of mandamus directing the respondents to pay the outstanding salary from the date of his joining and further continue to pay salary to the petitioners from month to month or show cause."
In view of the above, no useful purpose would be served to keep this writ petition pending.
Taking into consideration the facts and circumstances of the case, the end of the justice would be served by issuing a direction upon the respondent no.3 to consider the case of the petitioner and pass appropriate order in accordance with law expeditiously within a period of two months from the date of production of certified copy of this order. Needless to say that this Court has not expressed its opinion on the merits of the case and the respondent no.3 shall decide the matter in accordance with law.
The writ petition is accordingly disposed of.
