The applicant has invoked the jurisdiction of this Court with a prayer to direct the Civil Judge, (J.D.), Fast Track Court, District Kanpur Nagar to decide the complaint case no. 239 of 2016, Mohd. Haneef Vs. Mohd. Aadil, under section 138 of N.I.Act, P.S. Bekanganj, District Kanpur Nagar within a stipulated period.
Learned counsel for the applicant has submitted that the present proceeding has been pending since 2014 and the opposite party no.2 is lingering the trial on one pretext or other on account of which the applicant is suffering irreparable loss and injury.
Considering the facts and circumstances of the case this application is disposed of with the direction to the learned court below to make all endeavour to decide the aforementioned case expeditiously preferably within a period of six months from the date of production of a certified copy of this order without granting unnecessary adjournment to either parties and there is no other legal impediment in deciding the aforesaid case.
With the above observation, the application filed under section 482 Cr.P.C. is disposed of.
