THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.27449 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and Sri C.Sunil Kumar Reddy, learned standing counsel for APSRTC., appearing for the respondents.
This writ petition is filed seeking a mandamus, declaring the action of the respondents in not extending the benefit of Grade-I and 12 years stagnation increment as arbitrary and contrary to APSRTC regulations and consequently direct the respondents to consider the representation of the petitioner dated 16-8-2012 to extend the benefit of Grade-I and 12 years stagnation increment and pay the arrears by duly refixing the pay of the petitioner.
It is submitted by the petitioner that he is working as driver in the respondent corporation since 1994 and his services were regularized with effect from 1-08-2001. He completed more than 12 years of service and he is entitled for 12 years stagnation increment. According to the petitioner, his batchmates were extended the benefit of Grade-I driver scales, but his case was not considered for the said benefit. He made a representation dated 16- 8-2012 to the respondents 2 and 3 and the same is pending with them. The grievance of the petitioner is that though he is entitled for 12 years stagnation increment as per rules, no order has been passed on the representation made by him.
In view of the above circumstances, the respondents are directed to consider and dispose of the representation made by the petitioner dated 16-8-2012, where under he sought for 12 years stagnation increment, within a period of six weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly. There shall be no order as to costs. The Miscellaneous Petitions if any shall stand closed.
