ORDER:
This Writ Petition is filed for a mandamus to set-aside proceedings in Case No.A7/859/CS/2014, dated 12-12- 2014 of respondent No.2 whereby he has rejected the petitioner’s objections and declined to release the seized stock comprising 400 bags of rice (275 Quintals), 80 sugar packets (4.40 Quintals), 27 bags of wheat etc.
After hearing the learned counsel for both the parties, I am of the opinion that it would be in the interests of justice that the seized stock is not sold pending finalization of the proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short "the Act").
The Writ Petition is accordingly disposed of with the direction to respondent No.2 not to sell the seized stock till finalization of the proceedings under Section 6-A of the Act. He is also directed to conclude the proceedings and pass a final order within two months from the date of receipt of this order.
As a sequel to the disposal of the Writ Petition, WPMP No.48975 of 2014 is disposed of as infructuous.
