1. Heard Sri M.A. Hasan, learned counsel for petitioner, learned Standing Counsel for State of U.P. and Sri C.K. Parekh, learned counsel for respondent – Nagar Nigam.
2. Petitioner's tender has been cancelled by Nagar Nigam, Saharanpur, hence this writ petition challenging cancellation order dated 21.12.2017 passed by Executive Engineer, Nagar Nigam, Saharanpur.
3. Learned counsel for petitioner submitted that cancellation of tender is without any show-cause notice. When questioned, he could not show any provision to show that in contractual matters principles of natural justice are attracted.
4. The report submitted by Executive Engineer further shows that time for submitting tender was extended but it was not found valid by Commissioner, Saharanpur Division and therefore, there being illegality in the process of tender, same has been cancelled.
5. We therefore find no merit in the writ petition. Dismissed accordingly.
