The petitioner seeks for setting aside of the orders in Crl.M.P.No.1652 of 2013 on the file of the learned Metropolitan Sessions Judge, Hyderabad. On 06-3-2014, the learned Sessions Judge imposed costs of Rs.200/- payable to the Metropolitan Legal Services Authority, Hyderabad for condonation of delay of 10 days.
The petitioner did not choose to pay the costs accordingly. Consequently, the petition was dismissed. Questioning the same, the present revision is laid.
2. The learned counsel for the petitioner submitted that the petitioner was under the impression that the case stood adjourned by one week for payment of costs.
I believe that the petitioner ought to have verified the orders of the Court and ought to have complied with the orders. The petitioner was not ready to pay even costs of Rs.200/- that were imposed by the Court. I therefore consider that this petition deserves to be dismissed.
3. However, as a last chance, I consider it appropriate to give another opportunity to the petitioner to comply with the conditions, subject to payment of costs of Rs.2,000/- payable to the Metropolitan Legal Services Authority, Hyderabad.
4. Accordingly, this criminal revision case is disposed of directing the petitioner to deposit costs of Rs.2,000/- (Rupees two thousand only) to the credit of the Metropolitan Legal Services Authority, Hyderabad within one week from today failing which, the orders in Crl.M.P.No.1652 of 2013 hold good. If the costs are paid in the meanwhile, Crl.M.P.No.1652 of 2013 shall stand allowed. It is made clear that the learned counsel for the petitioner is present and heard the dictation of the order. The miscellaneous petitions, if any, pending in this revision shall stand closed.
