The petitioner claims that he was elected as Mutwalli of the Waqf by the members on 05.09.2018. The Waqf is created and registered by Mirza Yaseen Beg in the District Bijnor.
The grievance of the petitioner is that the application moved by the petitioner for the registered "Waqf Ali Ul Nafs Alal Aulad" under the Waqf Act, 1995 is still pending before the respondent no.1.
We have heard the learned counsel for the petitioner and Sri Punit Kumar Gupta, learned counsel for respondent nos. 1 and 2. Learned Standing Counsel appears for the newly impleaded respondent-State of U.P., respondent no.3.
Taking into consideration the facts and circumstances of the case, we are of the view that the ends of justice requires that a direction be issued to the respondent no,1 to consider and decide the petitioner's application preferably within two months from the date of communication of this order.
Needless to say that we have not expressed our opinion on the merits of the case. The respondent no.1 shall pass an appropriate order independently in accordance with law.
Accordingly, the writ petition is disposed of.
