JUDGMENT / ORDER

Hon'ble Devendra Kumar Arora,J.
Heard learned counsel for parties and perused the record. By means of this writ petition, the petitioner is seeking a direction for opposite parties not to disconnect the electricity connection of House No. 17/23-1, Picnic Spot Road, Indira Nagar, Lucknow.
In the instant case, petitioner is a tenant whereas electricity connection has been in the name of landlord, namely, Irfana Kidvai. There appears some inter se dispute between the landlord and the tenant with regard to rent and a suit for permanent injunction is pending before Civil Court. We are of the view that the tenant has an independent right to use electricity connection separately and he may apply for the same to the authority concerned of the Electricity Department. Therefore, no direction is required to be issued by this Court for restoration of the electricity connection of the petitioner.
Writ Petition is, therefore, disposed of finally with the direction to the opposite parties that if any application for electricity connection is moved by the petitioner, the same shall be considered in accordance with law and if electricity connection is provided to the petitioner, the same shall not confer any right upon the petitioner to claim against the landlord.
