Heard learned counsel for the petitioners; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 1st October, 2019 registered as Case Crime No.0839 of 2019, under Sections 506, 504, 323, 406 and 420 IPC and Section 3(2)(va) and Section 3(1)(Gha) of SC/ST Act at Police Station Majhola, District Moradabad.
The allegations in the impugned first information report are to the effect that the accused represented to the public at large that they have incorporated a company which accepts deposit on 10 per cent per month returns. It is alleged that by such false representation, they collected more than ten crores from the public and built properties for themselves and have cheated the public.
As the allegations are serious in nature and disclose commission of cognizable offences, the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail or anticipatory bail, as may be advised.
