Heard Sri Sarwar Ali Siddique, learned counsel for the applicant and Sri P.S. Jadon, learned A.G.A. for the State.
At the outset, learned counsel for the applicant submits that eight witnesses have already been examined and therefore, purpose of filing this application would be served if direction is issued to the trial court to decide the trial itself within a stipulated period.
Learned A.G.A. has no objection to this proposition. The application is dismissed as withdrawn.
However, trial court is directed to conclude the trial as expeditiously as possible preferably within eight months from the next date of recording the evidence.
It is made clear that this Court has observed nothing on the merits of the case and the trial court is at liberty to decide the trial in accordance with law.
It would be the duty of the applicant to communicate this order to the trial court by producing a copy of the same before it.
Registry is also directed to forward a copy of this order to the concerned trial court and concerned District Judge.
The party shall file computer generated copy of this order downloaded from the official website of High Court Allahabad, self attested by representative(s)/counsel of the applicant along with a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
