JUDGMENT / ORDER

Heard Sri Yakub Ansari, learned counsel for the petitioner and Sri Ashwani Kumar Mishra, learned Standing Counsel for the respondent no.1.
In view of the nature of the order sought to be passed it is not necessary to issue any notice to the respondent no. 2.
The petitioner is seeking a direction to the Commissioner, Jhansi, Division Jhansi to decide the appeal no.25 of 2012-13 (Gajraj Singh Vs. Mohd. Arif and Others).
From the order sheet, it is noticed that on several dates the case was adjourned only because due to some Resolution of the Bar Council Advocates are abstaining from legal work. There may be one or two genuine grounds for resolution by the Bar but there cannot be rampant disruption of Court due to Bar resolutions.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.1, Commissioner, Jhansi, Division Jhansi to consider and decide the appeal no.25 of 2012-13 (Gajraj Singh Vs. Mohd. Arif and Others) in accordance with law after giving an adequate opportunity of hearing to all the parties to the lis, whether counsel appear or not, if possible, within a period of six months from the date a certified copy of this order is received in his office.
It is further directed that no unnecessary adjournment will be granted to either of the parties.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
