HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 220 of 2014 Date: 15.09.2014 Between:
Mohd. Aqeel … Petitioner And The Union of India, rep., by its Secretary, Minority Welfare Department, New Delhi & others.
… Respondents This Court made the following:
THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 220 of 2014 ORDER: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition cannot be entertained with the material and the approach made therein. It seems to us that a representation was made by the petitioner when the State was undivided. Now two States have been formed. Therefore there must be two State Haj Committees.
In these circumstances, without making representation to both the Governments, the petitioner cannot approach this Court straight away. On that ground alone we dismiss the writ petition. However, liberty is given to the petitioner to approach both the State Governments for making representation.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
