(1) Heard the learned counsel for the parties and perused the record.
(2) This petition has been filed by the petitioner for the following main prayer:-
"Issue order or direction in the nature of Mandamus commanding/directing to direct the Civil Judge (Junior Division), Kunda, District Pratapgarh, (Respondent no.1) to decide the Original Suit No.744 of 2014 inre (Hussain Ahmad Vs. Mumtaz Ahmad & Others) in the court of Civil Judge (Junior Division), Kunda, District Pratapgarh, preferably within a stipulated period of time as fixed by this Hon'ble Court."
(3) It has been submitted by the learned counsel for the petitioner that the said Suit for cancellation of sale deed dated 19.12.1969 and also for permanent injunction was filed by the petitioner on 29.10.2014 in which written statement has been filed by the defendants on 23.02.2018 but till date no effective hearing has taken place.
(4) This petition is finally disposed of with a direction to the learned Trial Court to keep in mind the instructions issued on the Administrative side by the High Court to consider and decide all cases which have been pending for 5 years or more on a priority basis. Let the petitioner move an appropriate application for expedition before the District Judge, Pratapgarh, who shall consider the observations made hereinabove and pass appropriate orders expediting the case.
