This Criminal Petition is filed to direct the second respondent to comply CA.No.2825 of 2012 and furnish certified copy of judgment dated 20/06/2012 in SC.No. 5 of 2012 on the file of District and Sessions Judge, Nizamabad.
2. None appeared for the petitioner.
3. This matter is directed to be listed on 09/11/2012 under the caption of dismissal but it is not listed on 09/11/2012 but listed today.
4. From the petition averments, it appears that the petitioner is a witness in SC.No. 5 of 2012, who is the brother of deceased in the said case. He filed a copy application before the District and Sessions Judge, Nizamabad, for certified copy of the judgment in SC.No. 5 of 2012 in order to prefer appeal or revision against the said judgment and the allegation is that District and Sessions Judge has not furnished copy of the said judgment even though the same is very much available.
5. Now this criminal petition is filed under section 482 Cr.P.C. Supplying certified copy to a party is not a judicial act and it is purely an administrative act. Seeking direction against District and Sessions Judge, Nizamabad to perform an administrative act by invoking section 482 Cr.P.C., in my view is not permissible and on the face of it the petition is not maintainable. Therefore, this Criminal Petition is dismissed at the admission stage and it is unnecessarily pending since last two years.
