This writ petition has been filed, inter alia, for the following relief:
(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned notices dated 8th August, 2019 and 04.12.2019 issued by respondent no.4 under Section 13(2) and 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (Annexure -3 and 4 respectively to the writ petition). "
Heard the learned counsel for the petitioner and Mr.Sandeep Kuamr Singh, learned counsel for the respondent Bank and perused the record.
At the very outset, learned counsel for the respondent-Bank stated that the petitioner has got an alternative remedy under section 13(8) of the The Securitisation and Reconstruction of Financial Assets and Enforcement Security Interest Act, 2002 to his grievances . We find substance in it The writ petition is, accordingly, dismissed on the ground of alternative remedy .
However, it is provided that in case, the petitioner files an application before the appropriate authority within three weeks from today, the same shall be decided by the said authority expeditiously in accordance with law.
