Heard Sri Tawvab Ahmed Khan, learned counsel for the appellants and Sri S.C. Verma, learned counsel for the respondents.
The counsels have shown remarkable maturity in getting this appeal decided on the agreement, which is as follows:-
It is agreed between the parties that the Appeal No. 99 of 2013 pending before the District Judge or the Court concerned at Allahabad shall be decided along with Appeal Devective No. 90 of 2016 on merits within a period of six month ignoring the order dated 1.11.2018.
The counsel for the appellants shall be at liberty to file an application for injunction seeking stay on his eviction. The said application shall be decided by the District Judge or the Court concerned within a period of two weeks from the date of its filing without granting any adjournment.
This Court has not expressed any view with regard to the maintainability of Appeal Defective No. 90 of 2016, which issue shall also be decided by the District Judge uninfluenced by the observation made by this Court.
The present second appeal is being decided in terms of the said agreement of both the parties.
The Office shall take steps and shall positively return the record to the Court concerned by 6th December, 2019.
