Heard learned counsel for the petitioner; learned Standing Counsel for the respondent no.1; and Sri Sanjai Singh for the respondents 2 and 3.
The instant petition seeks quashing of the recovery proceedings initiated pursuant to notice under Section 13(2) of the SARFAESI Act.
It appears that a possession notice under Section 13(4) of the SARFAESI Act was also issued and published on 03.04.2019.
Under the circumstances, the petitioner has alternative remedy under Section 17 of the SARFAESI Act.
The petition is disposed off with liberty to the petitioner to avail alternative remedy.
