The sole relief claimed in the instant petition is for issuance of a direction to the Prescribed Authority before whom Rent Case No. 13/2002 under Section 21(1)(a) of U.P. Act No. 13 of 1972, is pending, at the behest of the petitioners, to decide the same, within a specified time.
Counsel for the petitioners submitted that the proceedings are pending since the year 2002,but the case has yet not been decided. A perusal of the order sheet reveals that certain party to the proceedings has died and the matter relating to substitution is pending.
Having regard to the fact that the case is pending since the year 2002, the petition is disposed of by directing the Prescribed Authority to make all endeavour to decide the substitution matter without delay, and thereafter proceed to decide the main case under Section 21(1)(a) expeditiously, without granting unnecessary adjournments to the parties.
