Heard learned counsel for the petitioner and learned standing counsel for the State-respondents.
Present petition has been filed for issue a writ of mandamus directing the respondent nos. 2 & 3 to make the payment of all post retiral benefit i.e. G.P.F., encashment, amount of insurance, Gratuity and pension etc. with the interest to the petitioner from the date he is entitled.
Learned counsel for the petitioner submitted that for redressal of his grievance, he has filed a representation dated 1.7.2021 before the respondent No. 3, but till date same has not been decided. He next submitted that a suitable direction may be issued to respondent No. 3 to decide the representation of the petitioner within stipulated period for which learned standing counsel has no objection.
Considering the facts and circumstances of the case, with the consent of the parties and without adverting on the merits of the case, the writ petition is disposed of directing the respondent No. 3 to decide the representation of petitioner dated 1.7.2021 strictly in accordance with law expeditiously, preferably within a period of two months from the date of production of computer generated copy of this order after verifying the same from official website of Allahabad High Court.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 3 to decide the representation of the petitioner after considering the relevant Acts, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
