Heard learned counsel for the applicant and the learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the impugned charge-sheet dated 24.11.2018 as well as order issuing Non-bailable Warrant dated 20.5.2019 by Addl. District and Sessions Judge, Court no. 7, Bijnor and u/s 82, 83 Cr.P.C. issued by Special Judge, POCSO Act, Bijnor and taken cognizance on 1.1.2019 in Case No. 302 of 2018 arising out of Case Crime no. 375 of 2018, u/s 363, 376 IPC and 3/4 POCSO Act, P.S. Nahtaur, District Bijnor, pending in the court of A.C.J.M., court no. 1, Bijnor.
The prayer for quashing the order impugned is refused.
However, it is provided that if the applicant file an application for recalling of the non-bailable-warrant issued against him within a period of three weeks from today, the said application shall be considered and disposed expeditiously in accordance with law.
For a period of three weeks, no coercive action shall be taken against the applicant. However, in case, the applicant does not appear before the Court below within the aforesaid period, coercive action shall be taken against him.
With the aforesaid observations, the present application is finally disposed of.
