It is argued by the counsel for the petitioners that in the suit filed by the petitioner being Original Suit No. 400 of 2020 (Mohatsim and Another vs. Meharban and other), an interim injunction was granted in his favour on 15.09.2020. Since the aforesaid order was not complied with, an application under Order 39 Rule 2-A was filed by the petitioners before the Court below on 15.09.2020, copy of which is appended as Annexure-3 to the writ petition. It is argued that inspite of the facts that considerable time has already been lapsed but till date no order has been passed by the court below on the aforesaid application.
Heard counsel for the petitioners and perused the record.
In the facts and circumstances of the case, without entering into merits of the case, the present petition is disposed of finally with a direction to the court below to pass appropriate order on the aforesaid application most expeditiously and preferably within a period of two months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
