Heard learned counsel for the applicants and the learned AGA.
This petition seeks quashing of complaint case No. 3724 of 2001 alleging commission of offences under Sections under Section 498A, 504,506 IPC and Section 3/4 D.P. Act From a perusal of complaint allegations, it cannot at this stage be said that the commission of offences referred to above is prima facie not evidenced. The submission of the learned counsel to the effect that earlier a complaint had been lodged at their instance against the complainant would clearly not detract from the allegations which have been levelled against the applicants.
Accordingly this Court finds no merit in the petition, which shall stand dismissed.
Dismissal of the application shall not preclude the applicants from applying for bail and in case such an application is filed, the same shall be considered by the concerned Court on its own merits bearing in mind the decisions rendered by this Court as well as the Supreme Court on the subject of grant of bail.
