Heard Sri Hemant Sharma, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking quashing of the order dated 15.3.2018 passed by the District Magistrate, Bulandshahar whereby he has imposed penalties on the petitioner alleging unauthorised mining. Aggrieved by the said order the petitioner preferred an appeal before the Commissioner which has also been dismissed by the other impugned order dated 07.01.2019.
Learned Standing Counsel points out that against the appellate order, the petitioner has a remedy of revision under Rule 78 of the Uttar Pradesh Minor Minerals (Concession) Rules, 1963.
We, therefore, dismiss this writ petition with liberty to the petitioner to avail his remedy of revision under Rule 78 of the Rules, 1963.
