JUDGMENT / ORDER

1. RULE.
Shri Dharmesh Shah, learned advocate waives service of notice of rule on behalf of the respondents.
2. The present application has been preferred by the applicants-original appellants-original plaintiffs for interim relief to stay further implementation, execution and operation of the impugned judgment and order passed by the learned Additional District Judge, Patan dated 10/05/2006 in Regular Civil Appeal No. 154/2002.
3. Having heard the learned advocates appearing on behalf of the respective parties and considering the fact that the main Second Appeal is admitted and in the meantime and during pendency of the main Second Appeal the third party rights are not created and consequently the Second Appeal does not become infructuous, by way of interim relief the parties to the proceedings are directed to maintain status-quo with respect to the suit property/land in question with respect to possession and title etc. Rule is made absolute to the aforesaid extent.
