1. Rule.
Mr. Bhavesh A. Patel, learned counsel waives service of notice on behalf of opponent Nos. 1 to 4 (original petitioners) and Mr. V.S. Patel, learned counsel appearing for H.L. Patel, learned counsel waives service of notice on behalf of respondent No.5 with the consent of the learned counsel appearing for the parties.
2. The application is taken up for final disposal forthwith.
3. Considering the averments made in the petition, more particularly para Nos. 8,9,13 and 14 of the application. The application deserves to be allowed and the applicants are directed to join as a party respondent in the Special Civil Application No. 4733/2011. The Civil Application is allowed. Rule is made absolute accordingly.
4. Registry is directed to amend the cause title forthwith.
