JUDGMENT / ORDER

The relief sought for in this Original Petition reads as follows:
“i. To direct O.S. No. 34/2010 on the file of the Additional Sub Court, Palakkad to be disposed within a time limit that may be fixed by this Hon'ble Court after fixing time limit for the filing of commission report and pre-trial steps.”
2. The petitioner points out that even though a Commissioner was appointed, the Commissioner is not filing his report and the matter is being dragged on to the detriment of the petitioner. Petitioner wants an expeditious disposal of the suit.
3. In the light of the order that is proposed to be passed in this Original Petition, notice to the respondents appears to be unnecessary.

4. It is averred in the petition itself that the Commissioner has not filed his report and pre-trial steps are yet to be taken. Further, it is stated that the Commissioner is taking repeated adjournments and the court is not keen to see that the report is filed.
In the result, this Original Petition is allowed and there will be a direction to the Additional Sub Court, Palakkad to take up O.S. 34 of 2010 and see that the Commission report is filed at the earliest and after pre-trial steps are completed within the time to be fixed by that court, dispose of the suit as expeditiously as possible.
