The petitioner is aggrieved with the non-consideration of an application filed under Section 33 (c) of the Industrial Disputes Act, 1947 before the 1st respondent. The application at Ext.P3 is found to be pending since 2005. 2. The learned Government Pleader, on instruction submits that the application was filed through the Secretary of the Union and that, after 2010 none appeared when the same was posted. The Union, in fact, had submitted that they are not pressing the matter, is the instruction received by the learned Government Pleader.
3. However, since the petition itself is filed by a workman through a Union, the officer has kept it pending. In such circumstance, the petitioner shall WPC.No.34132/2014 : 2 :
appear before the officer on 12.01.2015, upon which the first respondent shall issue notice to the respondents and consider the matter, at any rate, within a period of three months from the date of appearance. It is also submitted by the learned Government Pleader that the 2nd respondent is no more. In the circumstance, the petitioner would have to implead the legal heirs before the authority.
Writ petition is disposed of.
