(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) The applicant original petitioner has filed this contempt petition alleging that the insurance company while appointing Shri P. J. Malkan as second surveyor, as per the directions of this Court in order dated 28.3.2011 passed in Special Civil Application No.14291/2010, could not have asked for cost of such survey. We notice that in order dated 28.3.2011 though there is direction for appointment of Shri Malkan as surveyor, learned Judge has not given any direction with respect to who should bear such cost.
In that view of the matter, learned counsel for the petitioner sought permission to withdraw this contempt petition with a view to approach Learned Single Judge for clarification.
Permission as prayed for is granted. Disposed of accordingly.
