By way of this application under Section 397 of the Code of Criminal Procedure Code the applicant has challenged the order passed by the learned Metropolitan Magistrate, Court No.17, Ahmedabad in Inquiry Case No.14 of 2010 dated 26.8.2011 below Ex.1 and prayed to direct Assistant Commissioner of Police (G) Division to register FIR and investigate complaint under Section 156(3) of Code of Criminal Procedure Code, 1973.
Heard Mr.D.M.Ahuja, learned advocate for the applicant. Mr.Ahuja has read order passed by the learned Magistrate and contended that procedure will take time of years. He has prayed to direct learned Magistrate to dispose of inquiry within reasonable period of time. At this stage Mr.Ahuja seeks permission to withdraw this application. Permission as prayed for is granted. This application is disposed of as withdrawn.
The learned Metropolitan Magistrate, Court No.17, Ahmedabad, is directed to dispose of said inquiry under Section 202 of the Criminal Procedure Code within one year from the date of receipt of this order.
