From the perusal of the records of the contempt application, it appears that a writ petition preferred by the applicant seeking grant of retiral and pensionary benefit came to be disposed of with the following operative directions:
"In view of the above, without going into the merits of the claim of the petitioner, this writ petition is disposed of, with direction to respondent No. 3 to decide the representation of the petitioner dated 12th February 2014, in accordance with law, expeditiously, preferably within a period of four months from the date of production of certified copy of this order along with photo stat copy of the representation dated 12th February 2014 before it."
Aggrieved by the inaction, the applicant is stated to have instituted contempt proceedings which came to be disposed of on 20 August 2015 granting the opposite party one more opportunity to comply with the order of the writ Court. It is alleged that till date no compliance has been effected by the opposite party.
Accordingly, notices shall issue to the opposite party No. 1 returnable within four weeks.
The notice shall indicate that the petition shall be listed in Court on 29 February 2016.
The opposite party No. 1 shall file an Affidavit of compliance with the orders passed on the writ proceedings on or before the date fixed failing which he shall appear in person before this Court.
