As per the petitioner, on the property in question which is the subject matter of a suit pending before the Court of Sub- Divisional Magistrate, Gabhana, Aligarh under Section 116 of the U.P. Revenue Code, 2006, the local administration was trying to interefere and change the nature of the land.
Learned counsel for the petitioners submits that the local authorities are interfering with the possession of the parties at the behest of the defendants/respondents.
However, If the petitioners are aggrieved by the illegal interference of the State authorities, they may file an application for interim relief before the Court seized with the suit under Section 116 of the U.P. Revenue Code, 2006. If the petitioners file the application, the Sub-Divisional Magistrate, Gabhana, Aligarh shall pass orders within 10 days from filing of the application.
The writ petition is disposed of.
