Heard learned counsel for the petitioner.
Petitioner had purchased a house in which there are tenants. Petitioner has made a representation to the S.S.P., Mathura that the house be got vacated from the said tenants.
The petitioner has now filed this writ petition for a direction upon the S.S.P. to decide his aforesaid representation.
The decision of the aforesaid representation would serve no purpose inasmuch as the S.S.P. has no power in law to dispossess the occupants of the house much less the tenants. The petitioner has to take recourse to the civil remedies for the dispossession of the tenants from the house in dispute.
In view of the above, we are of the opinion that the writ petition is misconceived and is dismissed.
