This writ petition has been filed praying for a direction to the learned Court below i.e. the Court of A.C.M.M., IVth, Kanpur Nagar to decide the Rent Case No.3 of 2013 filed by the petitioner/landlord for release of the tenanted premises under section 21 (1) (a) U.P. Act No 13 of 1972 as expeditiously as possible within a time stipulated by this Court.
Learned counsel for the petitioner submitted that application under section 21 (1) (a) U.P. Act No 13 of 1972 was filed by the petitioner/landlord on 17.01.2013 and after more than one year, written statement was filed by the tenant/respondent on 18.02.2014 and replication was filed thereafter on 03.10.2015. Since 2015, the matter is being continuously listed before the learned Court below for evidence.
Under Rule 15 (3) of the Rules, an application under section 21 (1) (a) U.P. Act No 13 of 1972 should normally be decided within period of two months.
Accordingly, this writ petition is disposed of with direction to the learned Court below to consider and decide the application for release filed by the petitioner within a period of three months from the date of production of certified copy of this order before him.
