Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The instant petition under section 482 Cr.P.C. has been filed with the prayer to direct the trial court to expedite the Case No.2232/2018 (C.C.No.574/2001 (State vs. Mohan Babu Srivastava and Another) under section 409, 204 I.P.C. PS. Puranpur, District Pilibhit.
It is submitted by learned counsel for the applicant that the applicant has falsely been implicated in the present case by one Chandrajit Yadav, Upper Zila Sahakari Adhikari, Tehsil Veesalpur, Pilibhit alleging that the applicant has committed embezzlement of State Exchequer of Rs.305,420.65. The First Information Report was lodged in the year 2001. The charge sheet was submitted on 27.9.2002 pursuant to which the court below has taken cognizance. The applicant has already been released on bail. It is further submitted that the proceeding is still going on in snail's pace causing serious prejudice to the applicant, therefore, the court below may be directed to proceed with the case expeditiously and reach at logical conclusion within stipulated period granted by this Hon'ble Court.
Learned AGA contended that speedy trial is the quintessence of justice to ensure for every person to lead dignified life.The main aim of right to speedy trial is to inculcate justice in the society. It is the human life which necessitates human rights.
Regard being had to the facts and circumstances of the case, it is provided that the court below shall make constant endeavour to proceed with the case on the doctrine of de die in diem and will reach at logical conclusion within six months from the date a certified copy of this order is presented before the court below.
The application u/s 482 Cr.P.C. is disposed of as above.
